Construction partner’s article on Developing in Prime Locations published in Construction Law Journal

Construction partner Ben Kilshaw’s article on ‘ Developing in Prime Locations’ was published  in the Construction Law Journal September edition 2016.

In the article, Ben considers the host of legal and practical issues which developers encounter when developing land. There are issues in connection with obtaining planning permission, legal issues arising from covenants affecting the title to the land, rights of light issues, party wall matters to address under the Party Wall Act, contamination concerns and statutory utilities running through the land to name just a few. Finding sites in prime locations for development can be a challenge and sometimes the prime locations also have additional issues that developers and their contractors encounter.

In this article he discusses some such issues which Hamlins have encountered on projects that we have been involved in over the last few years, most of the issues arising in relation to London developments although some are applicable in other areas.
