Hamlins’ IP Partner discusses whether the boom in e-commerce is driving global counterfeiting in Intellectual Property Magazine

With consumers increasingly using the internet to buy goods, the marketing of counterfeits has never been easier says Philip Herbert.

Infringement statistics taken from the recent Organisation for Economic Cooperation and Development (OECD) and the European Union Intellectual Property Office (EUIPO) Joint Study (using data from 2013) identified that the international trade in counterfeit and pirated products was now worth in the region of €338bn per annum, which equates to 2.5% of total world trade. The problem was worse in the EU, with the report estimating that as much as 5% of all imports were of counterfeited and pirated products with a value of around €85bn.

In the article published in Intellectual Property Magazine, Hamlins’ IP partner Philip Herbert explains how e-commerce is spawning this rise in counterfeiting and what brand owners and retailers can do to improve their position. While it is easy to promote a range of legal remedies for counterfeiting issues, the whole customer experience is by far the single most important step that a brand owner or retailer can improve in not only maintaining its market share over its legitimate competitors but also keeping an edge over the counterfeiters.
